West Virginia FY 2022 Workers’ Compensation Rates

The West Virginia Office of the Insurance Commissioner has recently issued the new State average weekly wage for fiscal year 2022 (7/1/21 – 6/30/22).

For injuries occurring on or after July 1, 2021, the following maximum weekly worker’s compensation rates are effective in West Virginia:

Temporary total, permanent total and vocational rehabilitation benefits: $917.08 (paid at two thirds of the claimant’s average weekly wage not to exceed 100% of the State average weekly wage of $917.08);

Permanent partial and non-awarded partial benefits: $641.96 (paid at two thirds of the claimant’s average weekly wage not to exceed 70% of the State average weekly wage).

Current mileage reimbursement rate: 0.56 cents as of 1/1/21.
