2026/2027 Virginia and West Virginia Workers’ Compensation Rate Updates

The latest workers’ compensation benefit rates for Virginia and West Virginia are now in effect. Employers, insurers, third-party administrators, and claims professionals should be aware of these annual adjustments when evaluating claim exposure and indemnity benefits.

Virginia

Effective July 1, 2026

  • Maximum Weekly Compensation Rate: $1,507.01
  • Minimum Weekly Compensation Rate: $376.75
  • Maximum Employer Payment for Burial Expenses: Increased from $10,000 to $15,000

The increase in Virginia’s burial expense cap may affect exposure evaluations, reserve calculations, and settlement considerations involving compensable death claims.

West Virginia

Fiscal Year 2027 (Effective July 1, 2026)

  • Maximum TTD/PTD/Fatal Weekly Benefit: $1,150.91
  • Maximum PPD Weekly Benefit: $805.64
